2024 New Laws Enacted
The 2023-2024 Legislative Session concluded and legislators are now busy preparing for the upcoming election. This year legislators tackled numerous issues among which included artificial intelligence, discrimination, privacy, health care system consolidation, health care coverage and undocumented persons. CAHSAH’s major priority this year was achieving funding for Medi-Cal Private Duty Nursing skilled nursing rates.
CAHSAH tracked over 200 bills during 2024, of which 76 were signed into law. We have prepared our Annual New Laws Report which includes the new laws enacted by subject matter that are related to our industry or that are employer related. The bill number listed in the report is a direct link to the text of the new law. The report specifies if the bill has an urgency statute and when the bill was enacted into law. Bills with an urgency clause go into effect immediately; otherwise, the implementation date for the new law is January 1, 2025. A few of the major bills are summarized below.

AB 2011 (Bauer-Kahan D) Unlawful employment practices: small employer family leave mediation program: reproductive loss leave. CAHSAH worked with CEC to support this bill which will make the Civil Rights Department small employer family leave mediation program permanent, benefitting both workers and small employer.
AB 2288 (Kalra D) Labor Code Private Attorneys General Act of 2004. CAHSAH worked closely with CEC to reach this legislative compromise that reforms PAGA by limiting the range of suits eligible for PAGA, increases the employee’s share of the award from 25% to 35%, reduces monetary penalties for employers, and allows an employer under certain circumstances a right to cure an alleged wrongdoing on their part.
AB 2340 (Bonta D) Medi-Cal: EPSDT services: informational materials. CAHSAH supported this measure which requires the department to prepare written informational materials that effectively explain and clarify the scope and nature of EPSDT services that are available under the Medi-Cal program. The materials would include but would not be limited to the information required in federal regulations and include content designed for a beneficiary who is 12 years of age or older but under 21 years of age.
AB 2423 (Mathis R) Developmental services: rates. CAHSAH supported this measure which will commencing July 1, 2025, and contingent upon the appropriation of funds by the Legislature in the annual Budget Act and approval of federal funding, require the Department of Development Services (DDS) to review and update the rate models per the cost inputs available at the time of the review and post the updated rate models on its website no later than January 1 of the following year.
